Apple will pay 2,500 million to Chilean users for iPhone problems

The Organization of Consumers and Users (Odecu) reached a conciliatory agreement with Apple Chile, MacOnline and Reifschneider (local representatives of the brand) in the class action lawsuit filed at the end of 2018 for the problems in the batteries of the iPhone phones.

This initiative led more than 150 thousand consumers of the brand’s telephones – specified in the application – to register their membership.

Specifically, Odecu achieved a global amount of 84,167 Development Units, approximately 2,474 million pesos (USD 3.4 million) that will be distributed among the users of 7 models of iPhones, according to the following rules:

The final Individual Benefit that each user will receive will be calculated after the electronic registration process of all interested parties has elapsed, and will result from dividing the global amount indicated above between all those registered with a maximum limit of 1.25 UF ($ 37 thousand approx. / USD 50) per team involved.

The specific models included in the settlement agreement are:

  • iPhone 6
  • iPhone 6 Plus
  • iPhone 6s
  • iPhone 6s Plus
  • iPhone 7
  • iPhone 7 Plus
  • and iPhone 7 SE,

that have worked with the operating system iOS 10.2.1 or later (for iPhone 6, 6s, 6 Plus, 6s Plus and SE), or the operating system iOS 11.2 or later (for iPhone 7 and 7 Plus) before December 21 of 2017.

Users of the aforementioned models may request, electronically, the Individual Benefit through the official website of the conciliation that will be implemented by the auditing company Deloitte Chile, which is in charge of receiving the registrations and processing the payments.

The implementation of the agreement will begin as an estimated date of August 15, 2021. From that day and for a period of 3 months, as established in the agreement, potential beneficiaries may register their background on the official website of the conciliation.

During registration, consumers must make a sworn statement on the fact of having been users or users of any of the models that are part of this agreement and have experienced poor performance in the periods indicated, identifying the corresponding equipment through the number respective serial number.

Once the antecedents of all and all the interested parties have been received and verified that they comply with the agreement, Deloitte will have a maximum period of 60 days to proceed with the payment of the Individual Benefit by means of a bank deposit.
