Luigi Mangione’s scheduled New York state murder trial has been put on hold following his guilty plea last week to federal stalking charges in the killing of UnitedHealthcare CEO Brian Thompson. The postponement, ordered on Monday by New York state Justice Gregory Carro, forces prosecutors and defence lawyers to litigate whether the state case can proceed without violating double-jeopardy protections. Jury selection for the state case had initially been scheduled to begin on 8 September.

The legal dispute centres on whether prosecuting Mangione in state court after a federal guilty plea constitutes punishing him twice for the same conduct. Mangione’s defence team moved immediately to dismiss the state charges, arguing in their filing that the full range of conduct comprising the stalking offense is coterminous with the conduct committed as part of the murder offense. According to the defence, travelling from out of state to reach the crime scene does not eliminate the stalking from the acts constituting the murder, maintaining they form part of the same criminal transaction. Defence attorney Karen Friedman Agnifilo stated that the motion was filed to explain why the state charges must be dismissed under New York’s double-jeopardy protections.

Manhattan District Attorney Alvin Bragg’s office has signalled it will fight the dismissal. A spokesperson for the Manhattan District Attorney’s office stated that prosecutors had been tirelessly preparing to pursue a trial conviction and were prepared to litigate the defence motions. Assistant District Attorney Joel Seidemann previously argued in a letter that any guilty plea must account for the seriousness of the offences and the state’s interests in prosecuting Mangione, including the sanctity of life principle underpinning state homicide charges.

Legal scholars have expressed scepticism about the success of the defence’s motion. Professor Bennett Gershman of Pace University noted that New York state’s double-jeopardy law carves out exceptions for crimes that have different elements or are aimed at preventing very different kinds of harm or evil. Gershman pointed out that the federal stalking charges to which Mangione pleaded guilty still require intent to kill but do not require that the death actually occurs, making the elements in stalking and murder very distinguishable.

The case has also drawn intense political and public reactions. Conservatives, led by US President Donald Trump, have called for an example to be made of Mangione, while Jamie McDonald, the US attorney for the Southern District of New York, stated that there can be no celebrity in assassination. Meanwhile, supporters have gathered outside the Manhattan courthouse carrying signs such as “Free Luigi.”

In the federal proceeding, Mangione confessed to the shooting and detailed his frustrations with the health insurance system. Addressing the courtroom, Mangione explained his struggles with severe back pain and difficulties navigating the obstacles of the health insurance system while witnessing similar experiences of countless others. He admitted to following Thompson to a UnitedHealth Group investor conference before shooting him outside a Manhattan hotel.

"On the morning of December 4, 2024, I shot Mr Thompson in Manhattan and he died."

Luigi Mangione, defendant

Mangione entered his federal guilty plea without reaching an agreement with prosecutors, leaving no guarantee of leniency at sentencing. Federal sentencing is scheduled for 18 December. While federal sentencing guidelines recommend a term of 24 to 30 years, federal prosecutors have stated their intention to seek a life sentence, the maximum allowable. In the state case, Mangione has pleaded not guilty to eight charges, including second-degree murder, which carries the possibility of 25 years to life in prison.

Judge Carro has directed prosecutors to file their response to the double-jeopardy motion by 9 October. A state court hearing on the motion is scheduled for 10 December, which will help determine whether the state murder trial moves forward or is dismissed, thereby eliminating the possibility of consecutive prison sentences.
